Welcome to lenzhost. These Terms of Service ("Terms") govern your use of our website, products, and services, including web hosting, web design, business email, domain registration, marketing, and business services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Definitions
"lenzhost", "we", "us", or "our" refers to lenzhost, a South African service provider. "Client", "you", or "your" refers to any individual or entity that uses our services. "Services" means all products and offerings provided by lenzhost, including but not limited to shared hosting, web design, business email, domain registration, marketing services, and business services.
2. Acceptance of Terms
By placing an order, using our website, or accessing any lenzhost service, you confirm that you have read, understood, and agree to these Terms. If you are entering into this agreement on behalf of a company or organisation, you represent that you have authority to bind that entity.
3. Services Provided
3.1 Web Hosting
We offer NVMe shared hosting with features such as free SSL, cPanel, daily backups, and unlimited bandwidth (subject to fair use). Specific plan details are listed on our website. We reserve the right to modify features with reasonable notice.
3.2 Web Design
Our web design services include the creation of single-page, multi-page, and e-commerce websites. The scope, number of revisions, and deliverables are defined in the selected plan. Additional work outside the plan scope may be billed separately.
3.3 Business Email
Business email plans include email accounts, storage, and email authentication (DKIM, SPF, DMARC) as per plan details. We provide setup assistance; client is responsible for maintaining email usage within acceptable limits.
3.4 Domain Registration & Transfers
Domain registration, renewal, and transfer are subject to the terms of the relevant domain registry. Free domain offers apply only to eligible plans and billing cycles as stated. Domain ownership remains with the client, but we act as registrar/reseller. We are not responsible for domain loss due to non-renewal.
3.5 Marketing & Business Services
Google Ads and Meta Ads management, company profiles, Google Business Profile setup, and other business services are provided on a best-effort basis. Campaign results are not guaranteed, and client remains responsible for ad spend and compliance.
4. Billing and Payment
All fees are charged in South African Rand (ZAR) unless otherwise stated. Monthly, annual, and one-time billing cycles are as displayed on the website. You agree to pay all applicable fees on time. Failure to pay may result in suspension or termination of services.
We accept payments via credit/debit card, EFT, and other methods as indicated. You are responsible for any bank charges or exchange fees.
5. Renewals and Cancellations
Hosting and email plans renew automatically unless cancelled before the renewal date. Domain renewals are subject to registry timelines. To cancel any service, you must submit a cancellation request via our client area or support email at least 7 days before the next billing date. No refunds are provided for unused portions of the billing period except as required by law.
6. Refund Policy
We offer a 7-day money-back guarantee on new shared hosting plans only. Domain registrations, web design fees, and setup costs are non-refundable once work has commenced. If we fail to provide the agreed service due to our fault, we will refund the affected portion proportionally.
7. Acceptable Use Policy
You may not use our services for any unlawful, abusive, or harmful activity. Prohibited uses include, but are not limited to:
- Hosting of malware, phishing, or spam-related content
- Violation of intellectual property rights
- Distribution of illegal material
- Attempts to compromise network security
- Excessive resource consumption that affects other users
We reserve the right to suspend or terminate any account that violates this policy without prior notice.
8. Data Protection and Privacy
We handle personal information in accordance with the Protection of Personal Information Act (POPIA) and our Privacy Policy. By using our services, you consent to the processing of your data as described.
9. Intellectual Property
All website designs and code created by lenzhost for client projects remain the property of lenzhost until full payment has been received. Upon full payment, ownership of the final design and code transfers to the client, except for third-party components or licensed software (e.g., WordPress, Elementor Pro). You may not resell or redistribute our proprietary templates or code without written consent.
10. Limitation of Liability
To the maximum extent permitted by law, lenzhost shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services. Our total liability in any matter shall not exceed the amount paid by you in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold lenzhost harmless from any claims, damages, or expenses arising from your use of our services or violation of these Terms.
12. Termination
We may suspend or terminate your account if you breach these Terms, fail to pay, or engage in unlawful activities. You may terminate services at any time by cancelling through the client area. Upon termination, your data may be deleted after a reasonable grace period.
13. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with a revised effective date. Continued use of our services after changes constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.
