Website Design Agreement

This Website Design Agreement ("Agreement") applies to all website design, development, and managed website services provided by lenzhost. It should be read together with our Terms of Service, Privacy Policy, and Refund & Cancellation Policy.

1. Service Overview

lenzhost provides website design, development, hosting, and related services on a subscription basis. Our standard packages include:

2. The Design Process

Our website design process follows four simple steps:

1. Choose Your Plan — You select a website package on our website and complete payment.
2. Share Your Details — You complete our onboarding form and provide your business name, logo, brand colours, content, contact details, and preferred domain name.
3. We Build Your Website — lenzhost designs your website and shares a preview link. This typically takes 2–3 business days from receipt of all required content.
4. Review & Go Live — You review the website, request reasonable changes within the agreed scope, and approve the final design. Once approved, we publish the website.

3. Client Responsibilities

To allow us to deliver your website on time, you agree to:

• Provide accurate, complete, and lawful content, images, logos, and business information.
• Provide the required email account names and domain preferences.
• Respond to review requests and approval requests promptly.
• Confirm that you have the right to use any content, images, or trademarks you supply.

Delays in providing content or approvals will delay delivery. lenzhost is not responsible for missed timelines caused by delayed client input.

4. Scope of Work

The scope of work is limited to what is described in your selected website package. The following are not included unless separately quoted and approved in writing:

• Additional pages beyond the package limit
• Online stores, booking systems, or custom integrations (unless on Website Pro)
• Logo design or brand identity creation
• Copywriting, photography, or video production
• Ongoing content updates after launch
• Substantial redesigns after approval
• Third-party software licences beyond what is included

Any work outside the agreed scope will be quoted separately and must be approved in writing before we proceed.

5. Ownership

• Client content: You retain full ownership of all content, images, logos, and materials you supply.
• Final website design: Once all due amounts are paid, you own the final website-specific design and content created under this Agreement. You may use, modify, and migrate it.
• lenzhost retained rights: lenzhost retains ownership of reusable templates, code libraries, frameworks, methods, and know-how used across multiple client projects. These are licensed to you for use on your website but may not be resold or redistributed.
• Third-party components: Software, fonts, images, and platforms (such as WordPress, Elementor Pro, or premium plugins) remain subject to their own licences.

6. Domain Registration

Where lenzhost registers a domain on your behalf:

• The domain is registered in your legal name. You are the registrant of record.
• lenzhost acts solely as registrar/reseller and manages the technical registration.
• You are responsible for annual renewal fees. Non-renewal may result in loss of the domain.
• You may request a transfer of the domain at any time. Transfer assistance is provided free of charge.

7. Hosting, Backups, and Security

Your website package includes managed hosting on our infrastructure. The following applies:

• Hosting: NVMe storage with LiteSpeed web server technology, cPanel control panel, and Softaculous installer.
• Backups: Daily automated backups. Backups can be restored through cPanel automatic backups.
• SSL: Free SSL certificate included and configured.
• Security: Firewall, malware scanning, and routine security updates for core software and plugins.
• Restoration: In the event of data loss not caused by client-side changes, we will restore from the most recent backup at no additional cost.

Backup frequency and retention may be adjusted with reasonable notice.

8. Backend Access

You will receive a WordPress administrator account for your website. This allows you to log in, manage content, and make basic changes.

You will also have access to cPanel, which allows you to manage your hosting, email accounts, DNS, files, and backups. Support is available if you need help with anything in cPanel.

9. Support

Hosting, email, and website support is available via:

Support hours:

Support covers hosting, email, DNS, restoration from backups, and technical issues with the website. Website content changes, new pages, and design updates fall outside the scope and are quoted separately. See our Service Level & Support Policy for full details.

10. Fees and Payment

• Website packages are billed monthly in advance.
• The fee may change only on at least 30 days' written notice.
• If an invoice remains unpaid after written notice, lenzhost may suspend hosting or email until the account is brought up to date.
• Suspension does not erase amounts already due.

11. Term and Cancellation

This is a month-to-month agreement. Either party may cancel on 30 days' written notice. On cancellation, service continues through the paid period unless suspension is permitted under this Agreement.

12. Handover on Termination

On termination, lenzhost will provide, within 14 days of the effective termination date:

• A full backup of website files and database
• Domain transfer assistance if the domain is registered through lenzhost
• Email mailbox export where technically feasible

Client data will be deleted after a reasonable grace period unless otherwise agreed in writing. You should arrange any desired migration before service ends. Reasonable migration assistance may be quoted separately.

13. Privacy and Security

Each party will handle personal information only as reasonably needed for the service and in line with applicable South African privacy law (POPIA). lenzhost will use reasonable safeguards for systems under its control. You will keep passwords secure and promptly report suspected compromise. No internet or email service can be guaranteed to be uninterrupted or completely secure. 14. Service Standards and Liability

lenzhost will perform the service with reasonable care and skill. When a fault is reported, lenzhost will use reasonable efforts to investigate and restore service. Neither party is liable for indirect or consequential loss. To the extent permitted by law, lenzhost's total liability arising from this Agreement is limited to the fees paid by the client in the three months before the event giving rise to the claim. Nothing in this Agreement excludes rights or liability that cannot lawfully be excluded.

15. General

Written notices may be sent by email to the addresses used by the parties for this service. This document and any accepted written scope change form the whole agreement. If one term is unenforceable, the remaining terms continue. South African law applies. The parties will first try in good faith to resolve any dispute directly before starting formal proceedings.
